Terms & Conditions.
These Terms govern access to and use of Mango Discovery by organisations, tourism establishments and their authorised representatives.
Use Mango Discovery honestly, only represent businesses you are authorised to act for, keep establishment information accurate, and respect the rights of others. We review what enters the network and decide what is eligible to appear across Mango Getaway.
1. Agreement to these Terms
These Terms & Conditions (“Terms”) govern your access to and use of Mango Discovery, including its public pages, account services, organisation tools, establishment records, submission processes and related features.
Mango Discovery is operated as part of the Mango Getaway ecosystem by Mango Getaway LLC (“Mango Getaway”, “Mango Discovery”, “we”, “us” or “our”).
By creating an account, joining an organisation, submitting or managing an establishment, or otherwise using Mango Discovery, you agree to these Terms.
If you use Mango Discovery on behalf of a company, hotel, restaurant, tour operator, tourism organisation or other entity, you confirm that you have authority to accept these Terms on its behalf where applicable.
2. Who can use Mango Discovery
Mango Discovery is designed primarily for tourism businesses, organisations and people who legitimately represent them.
You must be legally capable of entering into a binding agreement and must satisfy any minimum age required by applicable law.
You may not use Mango Discovery if you are prohibited from doing so under applicable law or if we have suspended or permanently restricted your access.
3. Your account
You are responsible for providing accurate account information and keeping your login credentials secure.
You must not:
- share credentials in a way that compromises account security;
- impersonate another person;
- create an account using false identity information;
- attempt to access another member’s account without permission; or
- circumvent security or access controls.
You are responsible for activity performed through your account unless you have notified us of suspected unauthorised access.
We may require email verification, identity checks, authority confirmation or other reasonable security steps before certain features become available.
5. Establishment information
Information you submit about an establishment must be accurate to the best of your knowledge and must not be misleading.
This includes information such as:
- business and trading names;
- location and destination information;
- contact details;
- websites and booking links;
- establishment categories;
- services, facilities and amenities;
- opening or operating information;
- descriptions and factual claims; and
- other information submitted through Mango Discovery.
You should update material information when you become aware that it is no longer accurate.
We may distinguish between establishment-provided information, verified information and Mango Getaway editorial information.
6. Review, verification and duplicate records
Submission does not mean automatic approval.
Mango Discovery may review establishment information before allowing it to become discoverable.
Review may include checking:
- whether the establishment appears to exist;
- whether submitted information is internally consistent;
- whether the representative appears authorised;
- whether the destination relationship is appropriate;
- whether required permissions or declarations exist; and
- whether an existing record already represents the same establishment.
We may request additional information where reasonably required to complete a review.
If duplicate or conflicting establishment records exist, Mango Discovery may investigate, restrict, merge, supersede or otherwise resolve those records in accordance with its governance processes.
7. Discovery, publication and editorial decisions
Registration or verification does not guarantee that an establishment will be published, featured, recommended, ranked or promoted by Mango Getaway.
Mango Getaway retains editorial discretion over how, where and whether establishments appear within its destinations, content, Gateway, itineraries or other couple-facing experiences.
We may decide that establishment information is:
- not ready for publication;
- not relevant to a particular Mango Getaway experience;
- outdated;
- insufficiently verified;
- subject to a rights or governance issue; or
- otherwise unsuitable for a particular context.
8. Public establishment data
Some establishment information may be intended for public use, while other information is kept private or restricted.
Public establishment data may include information such as an establishment’s name, destination, website, public contact details, business category, booking links, operating information and other information reasonably intended to help people understand or contact the establishment.
The use and governance of public establishment information is explained further in the Mango Discovery Public Data Policy .
Account information and other personal information are handled separately under our Privacy Policy.
9. Media and intellectual property
You must only submit photographs, logos, videos, graphics, text or other content that you have the right to provide.
Submitting content does not transfer ownership of that content to Mango Discovery or Mango Getaway.
Where publication rights are required, the applicable upload process, declaration, permission or agreement may define how that media may be used.
You must not submit content that:
- infringes another person’s copyright or trademark;
- violates privacy, publicity or personality rights;
- contains unlawful material;
- misrepresents the establishment; or
- you are not authorised to provide.
Mango Getaway and Mango Discovery names, logos, software, page designs, editorial content and other proprietary materials remain owned by their respective rights holders.
10. Acceptable use
You may not use Mango Discovery to:
- submit knowingly false or fraudulent information;
- impersonate another organisation or establishment;
- harass, threaten or abuse another user;
- upload malicious code;
- probe, attack or interfere with platform security;
- scrape or harvest restricted account information;
- circumvent access restrictions;
- manipulate verification or review processes;
- create misleading duplicate records;
- infringe intellectual property or privacy rights; or
- use the service for unlawful purposes.
We may take reasonable action to protect users, businesses, data, security and the integrity of Mango Discovery.
11. Commercial relationships are separate
Creating a Mango Discovery account or establishment record does not create a sponsorship, advertising arrangement, paid placement, commission agreement or commercial partnership with Mango Getaway.
Any paid visibility, campaign, sponsorship, affiliate, placement or commercial arrangement must be governed by a separate agreement or clearly identified commercial terms.
Payment for one Mango Getaway product or service does not automatically guarantee ranking or editorial endorsement elsewhere in the ecosystem.
12. Third-party services and links
Mango Discovery and Mango Getaway may link to establishment websites, booking engines, map providers, social networks, payment services or other third-party services.
Those services are operated independently and may have their own terms, privacy practices and policies.
Unless expressly stated otherwise, Mango Discovery is not responsible for the availability, content, products, transactions or practices of third-party services.
13. Privacy
Our handling of personal information is described in the Mango Discovery Privacy Policy .
You are responsible for ensuring that personal information you provide about another individual has been collected and shared lawfully.
14. Suspension, restriction and termination
We may restrict, suspend or terminate access to Mango Discovery where reasonably necessary, including where:
- these Terms are materially breached;
- account security appears compromised;
- authority to represent an organisation is disputed;
- information appears fraudulent or materially misleading;
- required legal acceptance is no longer valid;
- continued access presents a security or legal risk; or
- the service or relevant feature is discontinued.
Where appropriate, we may provide an opportunity to correct an issue before permanent action is taken.
Establishment records may remain archived or retained where reasonably necessary for legal, audit, fraud-prevention, historical or data-integrity purposes.
15. Service disclaimers
Mango Discovery is provided on an “as available” basis.
We aim to operate the service reliably, but we do not guarantee uninterrupted or error-free availability.
To the fullest extent permitted by law, we do not guarantee:
- publication or continued publication of an establishment;
- placement within any particular destination or page;
- specific traffic, leads, enquiries or bookings;
- a particular search position or ranking;
- editorial coverage;
- commercial results; or
- continued availability of every feature.
Establishments remain responsible for their own products, services, guests, bookings, prices, operations and legal obligations.
16. Limitation of liability
Nothing in these Terms excludes or limits liability where doing so would be unlawful.
To the fullest extent permitted by applicable law, Mango Discovery, Mango Getaway and their officers, members, employees and service providers will not be liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, business opportunity, goodwill or data arising from use of Mango Discovery.
To the fullest extent permitted by law, our aggregate liability relating to Mango Discovery will not exceed the amount you paid directly to us for the specific Mango Discovery service giving rise to the claim during the twelve months immediately preceding the event giving rise to liability, or US$100 if no amount was paid.
17. Your responsibility for claims
To the extent permitted by law, you agree to indemnify and hold harmless Mango Getaway and its officers, members, employees and service providers from third-party claims, losses, liabilities and reasonable costs arising from:
- information or content you submit;
- your lack of authority to represent an organisation or establishment;
- your infringement of another person’s rights;
- your unlawful use of Mango Discovery; or
- your material breach of these Terms.
18. Changes to these Terms
We may update these Terms as Mango Discovery evolves or where legal, security or operational requirements change.
The current version and effective date will be identified on this page.
Where an update materially changes the terms applicable to an account or organisation, Mango Discovery may require renewed acceptance before continued use of affected account features.
19. Governing law
These Terms are governed by the laws of the State of North Carolina, United States, without regard to conflict of law principles, except where another law must apply as a matter of mandatory law.
Subject to any rights that cannot lawfully be waived, disputes relating to these Terms or Mango Discovery will be brought before a court of competent jurisdiction in North Carolina.
20. General provisions
Entire agreement
These Terms, together with policies and terms expressly incorporated by reference, form the agreement governing your use of Mango Discovery unless a separate written agreement applies to a particular service.
Severability
If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect to the fullest extent permitted by law.
No waiver
A failure to enforce a provision of these Terms does not waive our right to enforce it later.
Assignment
You may not transfer your rights or obligations under these Terms in a way that transfers control of an account or establishment record without our consent where such consent is reasonably required.
We may transfer these Terms as part of a merger, reorganisation, acquisition, sale of relevant assets or other lawful corporate transaction.
